Background

A village exposed to reprisals

Kumarapuram lay in an area of recurrent fighting. The killings followed the deaths of two soldiers in an LTTE attack nearby. Residents sheltering in their homes were not thereby participants in that attack.[1]

What happened

    Homes were attacked

    Survivors described soldiers and home guards firing on civilians. Twenty-six people were killed and others seriously injured. The victims included women and children; accounts also record the rape and killing of a teenage girl.[1]

1996–2016

Witness evidence and the trial

The case proceeded through years of delay before six accused former army personnel were acquitted in 2016. An acquittal determines whether the prosecution proved those defendants’ guilt; it does not mean that the 26 deaths did not occur.[1]

Aftermath & legacy

Survivors pursued accountability

Amnesty cited Kumarapuram among cases illustrating obstacles to justice in Sri Lanka. Survivors continued to identify the men they believed responsible and sought investigation despite fear and repeated delays. Their efforts eventually led to a trial two decades after the killings, followed by acquittals.[2]

The 2016 verdict

On 27 July 2016, the Anuradhapura High Court acquitted six former army corporals. The Centre for Human Rights and Development records charges concerning 24 deaths, whereas contemporary accounts of the massacre report 26 people killed overall. The number covered by an indictment and the reported total victims describe different things; acquittal did not establish that the massacre never occurred.[3]
